Hello Habanero provides website design and development, web application development, SEO, branding, and related digital services. The scope, deliverables, timeline, and pricing for each engagement are defined in a separate service agreement or proposal agreed upon by both parties.

We reserve the right to refuse service to anyone for any reason at any time. We are not responsible for delays caused by factors outside our control, including client delays in providing content, approvals, or feedback.

We accept: Visa, Mastercard, American Express, Discover, Google Pay, and Apple Pay.

You agree to provide accurate and complete payment information. We may change prices at any time. All payments are in U.S. dollars. Sales tax may be applied as required. Monthly service fees are billed in advance and are non-refundable once the billing period has begun.

Past-due balances may result in suspension of services. We are not liable for any disruption to your business resulting from a service suspension due to non-payment.

By providing your mobile phone number and checking the SMS consent box on our forms, you agree to receive SMS and MMS messages from Hello Habanero. Messages may include payment reminders, invoices, receipts, account notifications, and service-related communications.

You agree not to:

• Scrape or systematically retrieve content to build a competing database or directory
• Trick, defraud, or mislead us or other users
• Circumvent or disable any security features of the site
• Disparage or harm Hello Habanero or the site
• Harass, abuse, or harm any person using information from the site
• Submit false abuse reports or misuse our support services
• Engage in unauthorized framing of or linking to the site
• Use the site in any way inconsistent with applicable laws or regulations

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. HELLO HABANERO DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We do not guarantee specific results from our SEO, marketing, or web services. Search engine rankings, conversion rates, and business outcomes are influenced by many factors outside our control.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HELLO HABANERO AND ITS OWNERS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION — ARISING FROM YOUR USE OF THE SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total amount paid by you to Hello Habanero in the three (3) months preceding the claim.

These Terms and any dispute arising from them shall be governed by the laws of the State of Washington, without regard to conflict of law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Benton County, Washington.

Before initiating any formal dispute, you agree to first contact us at contact@hellohabanero.com and attempt to resolve the matter informally within 30 days.

We reserve the right to suspend or terminate your access to our services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination of a service agreement, you remain responsible for all fees incurred up to the termination date. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property rights, disclaimer of warranties, limitation of liability, and governing law.
